 為貫徹落實黨中央、國務(wù)院深化放管服改革和優(yōu)化營商環(huán)境的部署,進(jìn)一步提高本市工程建設(shè)項目審批效率,根據(jù)《國務(wù)院辦公廳關(guān)于全面開展工程建設(shè)項目審批制度改革的實施意見》(國辦發(fā)〔201911號)和《天津市深化工程建設(shè)項目審批制度改革實施方案》(津政發(fā)〔201925號)精神,擬定了《市住房城鄉(xiāng)建設(shè)委關(guān)于印發(fā)天津市工程建設(shè)項目審批流程施工許可階段并聯(lián)審批工作機(jī)制的通知》(征求意見稿),現(xiàn)對該通知公開征求意見。

根據(jù)《國務(wù)院辦公廳關(guān)于全面開展工程建設(shè)項目審批制度改革的實施意見》(國辦發(fā)〔201911號)和《天津市深化工程建設(shè)項目審批制度改革實施方案》文件精神,制定天津市工程建設(shè)項目審批流程施工許可階段并聯(lián)審批工作機(jī)制》(津政發(fā)201925號)的通知,現(xiàn)印發(fā)給你,請認(rèn)真貫徹落實相關(guān)工作。

為貫徹落實黨中央、國務(wù)院深化放管服改革和優(yōu)化營商環(huán)境的部署,進(jìn)一步提高本市工程建設(shè)項目審批效率,根據(jù)《國務(wù)院辦公廳關(guān)于全面開展工程建設(shè)項目審批制度改革的實施意見》(國辦發(fā)〔201911號)和《天津市深化工程建設(shè)項目審批制度改革實施方案》津政發(fā)201925號)精神,制定工作機(jī)制如下:

一、實施原則

將工程建設(shè)項目審批流程主要劃分為立項用地規(guī)劃許可、工程建設(shè)許可、施工許可、竣工驗收四個階段。按照項目不同類型,實行分段審批、并聯(lián)辦理、交叉進(jìn)行、告知承諾、限時辦結(jié)。繼續(xù)深化施工許可階段行并聯(lián)審批改革,減少建設(shè)單位多頭申報、各部門多頭審批,加快建設(shè)項目早日開工建設(shè)。

施工許可階段通過由市、區(qū)兩級施工許可審批部門牽頭組織,實行一家牽頭、并聯(lián)審批、限時辦結(jié),進(jìn)一步強(qiáng)化并聯(lián)審批機(jī)制,確保本階段由牽頭部門組織協(xié)調(diào),相關(guān)部門嚴(yán)格按照限定時間完成審批。

、實施內(nèi)容及實施部門

施工許可階段事項包括施工圖(聯(lián)合審圖)審查、建設(shè)工程質(zhì)量監(jiān)督手續(xù)辦理、建筑工程施工許可核發(fā)。其中,并聯(lián)辦理事項為建設(shè)工程質(zhì)量監(jiān)督手續(xù)辦理與建筑工程施工許可證核發(fā)。參與施工許可階段并聯(lián)辦理部門包括質(zhì)量監(jiān)督部門、施工許可審批部門。

取消本市范圍內(nèi)建設(shè)工程安全登記,調(diào)整為安全資料查驗后由工程安全監(jiān)管部門作事中事后監(jiān)管。

、并聯(lián)審批申報材料

1.建設(shè)工程質(zhì)量監(jiān)督手續(xù)辦理建筑工程施工許可合并辦理申請表;

2.五方責(zé)任主體的法定代表人簽署的授權(quán)書與《建設(shè)工程五方主體項目負(fù)責(zé)人工程質(zhì)量終身責(zé)任承諾書》《建設(shè)工程五方主體項目負(fù)責(zé)人工程安全終身責(zé)任承諾書》;

3.依法確定承包人的材料;

4.天津市房屋建筑和市政基礎(chǔ)設(shè)施工程施工圖設(shè)計文件審查合格書;

5.用地批準(zhǔn)手續(xù);

6.建設(shè)工程規(guī)劃許可證;

7.施工企業(yè)主要技術(shù)負(fù)責(zé)人簽署的已經(jīng)具備施工條件意見書。

注:除以上申報材料,申請辦理建設(shè)工程質(zhì)量監(jiān)督手續(xù)辦理還需提供危險性較大的分部分項工程清單,此項申報材料可采用告知承諾方式申請。

未納入施工圖審查范圍的項目,實行施工圖設(shè)計質(zhì)量告知承諾制和事中事后監(jiān)管。以建設(shè)單位及勘察設(shè)計單位出具告知承諾函,對施工圖設(shè)計質(zhì)量與消防設(shè)計質(zhì)量作出承諾,以此辦理建設(shè)工程質(zhì)量監(jiān)督手續(xù)建筑工程施工許可

、辦理流程

(一)窗口接件

根據(jù)建設(shè)項目管轄權(quán)限,建設(shè)單位持申報材料,到市或區(qū)聯(lián)合審批綜合服務(wù)窗口進(jìn)件,通過一張表單進(jìn)行施工許可并聯(lián)審批階段申報聯(lián)合審批綜合服務(wù)窗口工作人員按照職責(zé)分工核對申請材料。

(二)窗口受理

窗口接件后,由聯(lián)合審批綜合服務(wù)窗口工作人員負(fù)責(zé)將申請材料即時送達(dá)并聯(lián)審批部門受理窗口。建設(shè)單位提交的申請材料齊全且符合法定形式的,應(yīng)當(dāng)場受理并出具受理決定書;申請材料不齊全或不符合法定形式的,受理窗口工作人員應(yīng)一次性告知補(bǔ)正意見,提交綜合窗口并向建設(shè)單位出具補(bǔ)正材料通知書。

(三)部門辦理

建設(shè)工程質(zhì)量監(jiān)督手續(xù)辦理、建筑工程施工許可由市或區(qū)級工程質(zhì)量登記、施工許可審批部門合并辦理,并在1個工作日內(nèi)同時發(fā)證。

(四)辦結(jié)出件

各并聯(lián)審批部門在事項承諾時限內(nèi),出具相應(yīng)批文,由聯(lián)合審批綜合服務(wù)窗口通知申請人領(lǐng)取。

、強(qiáng)化并聯(lián)審批機(jī)制措施

(一)全面落實施工許可階段并聯(lián)審批。結(jié)合全面深化工程建設(shè)項目審批制度改革工作,強(qiáng)化“一口進(jìn)件、階段辦理、牽頭負(fù)責(zé)、并聯(lián)審批、一口出件”的并聯(lián)辦理制度,科學(xué)合理設(shè)計并聯(lián)事項,切實提高建設(shè)項目并聯(lián)辦理率,進(jìn)一步壓縮辦理時限,提高辦事效率。

(二)深化全市統(tǒng)一的工程建設(shè)項目審批管理平臺應(yīng)用。通過市區(qū)兩級統(tǒng)一的橫向到邊,縱向到底 聯(lián)合審批系統(tǒng)平臺,將施工許可階段涉及的事項全部納入平臺管理,全程鎖控項目信息和辦理過程,完善到期預(yù)警、超期警示、催辦督辦、過程糾偏、異常處理等功能。推進(jìn)市、區(qū)兩級各相關(guān)審批部門和監(jiān)管部門打通信息共享通道,建立工作協(xié)同機(jī)制,實現(xiàn)審批流程全公開、審批信息全共享、審批行為全監(jiān)控。

(三)強(qiáng)化對審批、服務(wù)人員的培訓(xùn)管理。要加強(qiáng)對市、區(qū)兩級審批窗口工作人員培訓(xùn),要求熟練掌握與業(yè)務(wù)相關(guān)的政策法規(guī)和辦理流程,以理論考試、窗口實際操作考核方式檢驗培訓(xùn)效果,提升服務(wù)水平。

建設(shè)、勘察、設(shè)計單位告知承諾函

 

          (建設(shè)單位)承建的          (項目名稱),委托                   (勘察、設(shè)計單位名稱)負(fù)責(zé)編制勘察設(shè)計文件。目前,已完成編制工作并交付建設(shè)單位?,F(xiàn)對有關(guān)情況做出如下承諾:

1. 按照《市住房城鄉(xiāng)建設(shè)委關(guān)于深化施工圖第三方審查改革有關(guān)工作的通知》規(guī)定,本項目不在施工圖第三方審查范圍內(nèi);

2. 本項目嚴(yán)格按照國家法律法規(guī)、標(biāo)準(zhǔn)規(guī)范進(jìn)行勘察設(shè)計,無違反強(qiáng)制性標(biāo)準(zhǔn);滿足建設(shè)工程規(guī)劃、人防、選址、設(shè)計、巖土治理等要求,符合國家頒布的設(shè)計文件編制深度,能夠滿足施工需要,并依法對設(shè)計使用年限內(nèi)工程質(zhì)量承擔(dān)相應(yīng)終身責(zé)任;

3. 嚴(yán)格按照消防法規(guī)及消防技術(shù)標(biāo)準(zhǔn)進(jìn)行滿足施工許可的設(shè)計,并依法對消防設(shè)計質(zhì)量承擔(dān)相應(yīng)終身責(zé)任;

4. 施工圖設(shè)計文件和告知承諾函已按規(guī)定上傳至“天津市數(shù)字化審圖系統(tǒng)”;

5. 無其他違法、違規(guī)的行為。

如違反以上承諾內(nèi)容,我單位自愿承擔(dān)相應(yīng)的法律責(zé)任及不良信用評估后果。
